Powers Granted to the Government by the People
Constitutional Concepts Foundation is in the unique position of having many e-mails and messages sent to our web site detailing the abuses, usurpations, and persecutions that are being perpetrated on our fellow Citizens by our own government.
As we have repeatedly pointed out
"It is ludicrous to think that our Founding Fathers, after risking their lives by signing the Declaration of Independence, fighting, and winning, the War of Independence, and then struggling to establish a Republican form of government, would then turn around and grant that government the power and authority to allow it to become abusive of the people. They would not do it, and they did not do it."
Our government is oppressive -
it is totally out of control.
It rears its ugly head into areas that are way beyond what our Founding Fathers envisioned.
It violates our rights with impunity.
Don't our public servants know
our government was created for the sole purpose
of protecting our rights?
That to secure these rights, Governments are instituted among Men,
deriving their just powers from the consent of the governed, - Declaration of Independence
Don't our public servants know that governments get their just powers from the People?
Since our public servants are using powers we did not give them,
then they must be using unjust powers.
And -- Since the "just powers"
are based on our God given unalienable rights -
The "unjust powers" must come from Satan -
and are therefore -
5 And that law of the land which is constitutional, supporting that principle of freedom in maintaining rights and privileges, belongs to all mankind, and is justifiable before me.
6 Therefore, I, the Lord, justify you, and your brethren of my church, in befriending that law which is the constitutional law of the land;
7 And as pertaining to law of man, whatsoever is more or less than this, cometh of evil.
8 I, the Lord God, make you free, therefore ye are free indeed; and the law also maketh you free.
9 Nevertheless, when the wicked rule the people mourn.
10 Wherefore, honest men and wise men should be sought for diligently, and good men and wise men ye should observe to uphold; otherwise whatsoever is less than these cometh of evil.
11 And I give unto you a commandment, that ye shall forsake all evil and cleave unto all good, that ye shall live by every word which proceedeth forth out of the mouth of God.
12 For he will give unto the faithful line upon line, precept upon precept; and I will try you and prove you herewith. - Doctrine and Covenants | Section 98:5-12
If that's true -
how did we get ourselves in so much trouble,
and how do we get out of it?
First, we must understand that we did get ourselves into this mess.
We did it by not watching our backside.
We let people that we trusted, those that we elected or appointed -
cheat us, and steal from us, and commit fraud against us.
There is no criminal so vile as the one
who poses as a trusted friend in order to cheat us
Are we so far gone that we have no hope of recovery?
Is there anything we can do to get out of this mess?
We can get our of our mess
BUT - in order to do it --
We absolutely need to know what boundaries are established by our Constitution.
After all, our Constitution is the cage that was built by our Founding Fathers
to define and control what our government can do.
How can we expect to win the game
if we don't even know the rules?
We'll just continue to lose every role of the dice
until we know how to properly control our public servants.
Where can we learn the rules?
Our Constitution clearly defines the rules -
and states exactly what our public servants are allowed to do -
and to not do.
As you go through the Analysis Chart
please note that there are no provisions in our Constitution
that permits the Federal government any law enforcement powers of any kind.
but, without the ability to persecute the people
with bogus law enforcement activities
the government workers have no ability to
to extort, and to intimidate, the people
so they can build empires,
have the courts create phony laws,
and allow the legislature to ignore the provisions of our Constitution.
We live in fear of our own government.
Times have changed.
The meanings of some words have changed.
Now, with over 200 years of "hind-sight"
we have a better idea of what needs to be clarified
in order to secure our freedom and pass it on to our posterity.
What we are proposing
is that We, the People of the united States of America,
establish our own "People's Bill of Rights"
so that we may reclaim our Republican Form of government
that our Founding Fathers gave us,
put our rampant government back in its cage,
and once again enjoy our God given unalienable rights.
But, more important we will be able to pass
the blessings of Freedom and Liberty on to our posterity.
This is not a new concept.
These are just a few of the documents that proclaim the Life, Liberty, and Freedom of the people.
On May 28, 1215, King John was held at sword point and forced to sign the Magna Carte.
On November 11, 1620, the Mayflower Compact was signed.
In 1628, the Petition of Right
In 1689, the English Bill of Rights
in 1701, the Act of Settlement
On October 19, 1765, the Resolution of the Stamp Act Congress
In October, 1774, the Declaration and Resolves of the First Continental Congress
On July 4, 1776, the Declaration of Independence
In 1791, The Bill of Rights was added to our Constitution
Our "People's Bill of Rights" will not amend the Articles of our Original Constitution, It will simply clarify the principles behind each Article and define the terminology.
Bringing this to the attention of the People was not possible just a few short years ago, but now, with the Internet we can all join into the discussions and participate in "righting our ship of state" so we can sail into the future in a manner that will best effect our safety and happiness.
Do we have the right to do this?
Not only do we have the right - it is our duty, and our obligation to do this. Let us quote from the "Declaration of Independence" concerning this matter:
Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shown, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object, evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future Security - Declaration of Independence
Please take a good look at our proposed "People's Bill of Rights."
If you approve of what we are doing, or do not approve of what we are doing, You can vote either for, or against, our "People's Bill of Rights" by following the proper procedure set forth.
It is our intent to advertise in the news media
and through the Internet,
and by word of mouth as to what we are doing.
We invite everyone to participate in our efforts to reclaim our Republic.
We want to use the time between now and September 8, 2006
to collect as many signatures as we can.
We plan to announce the results of the vote on September 11, 2006.
It's our turn to make an impact on September 11th
by striking a blow for Freedom and Liberty.
That gives us about 5 months to complete our work and announce the results.
And, when we are through, will our efforts mean anything?
That's entirely up to you!!
Each of us needs to make sure that all of our family and friends participate, and vote. There must be enough of us to show our corrupt and wayward courts and politicians that we are serious.
But, by the same token, by throwing the opportunity to participate open to everyone, and then holding a national vote we will have met the requirement that this is the voice of the People.
Even though not everyone votes in a Presidential election the results of that election is the voice of the People.
Same thing here. As long as we have given everyone an ample opportunity to participate and to vote, our efforts will be successful.
Over the next couple of months we will devise a plan so that everyone who wants to vote, will have the opportunity to do so. We want every person over the age of 18, who is living in one of the several States or the District of Columbia, to cast their vote on our "People's Bill of Rights." Plans for a national vote will be announced as they are finalized.
Before we start it is necessary to establish some basic facts so we are all on the same page.
We still place our right hand over our heart and solemnly proclaim our allegiance to the flag of the United States of America and to the Republic for which it stands.
I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands: one Nation under God, indivisible, With Liberty and Justice for all.
We have not pledged our allegiance to a Democracy, or to an Oligarchy. We have pledged our allegiance to our Republic. Yes, it is still our Republic because We, the People, have never voted to change it.
Republic: A form of government where God's law is supreme and the people are free to pursue and to enjoy their Life, Liberty and Pursuit of Happiness. Each Citizen retains their own Sovereignty and has control over his personal environment. The Sovereign Citizens are subject to God's Laws, primarily the Ten Commandments, the "Golden Rule," and especially, Love thy Enemy.
Democracy: A form of government where the majority rules. This type of system is fraught with the ever present potential that the majority will make slaves of the minority, or, that power hungry men and women will subvert the system for their own benefit. God is outlawed, and God's laws are totally disregarded. Eventually the majority attempts to install themselves as the god of the nation. Today, in our court rooms in every State, the attorneys "PRAY" to the judge for the orders they seek.
Oligarchy: A form of government where a select group of individuals have gained control over the actions and activities of the government and have placed themselves, and their cohorts, above the law, by claiming immunity from redress for themselves and their associates.
We are repeatedly told that we have a Democracy. Our new media, our politicians, our teachers, all talk freely about our Democracy.
In many ways a Democracy is simply "mob rule."
Whoever has the largest mob makes the rules.
Our Founding Fathers understood this, and so they gave us a Republican form of government based on Common Law, which is the People's Law, and on Christian concepts, doctrine, and teachings, and We, the People have never changed it.
They did not create a Democracy. They understood and knew that a Democracy was the first step to a Dictatorship, and that an Oligarchy was a form of Dictatorship.
The language and the words used herein shall be construed to be the common everyday language of the people. No hidden implied messages or meanings are expressed, or conveyed, herein. What these Articles and provisions say is exactly what they are meant to say, and exactly what they mean.
In order to make sure we don't miss something we'll go through the Constitution paragraph by paragraph.
In the "Powers Granted" Column
we will acknowledge what powers have been granted to our public servants.
There will also be a statement that clarifies when
no powers have been granted that would give the government
jurisdiction over the people, or the actions of the people.
