People's National Constitutional Convention

This is an opportunity of a lifetime.
Through the Internet it is now possible for everyone to participate
in a National Constitutional Convention
in order to restore our Republican Form of Government
and to reclaim the power of the People
We, at Constitutional Concepts Foundation
have had the opportunity to see the various e-mails and messages
that have been sent to our web site detailing the abuses, usurpations, and persecutions
that are being perpetrated on our fellow Citizens by our own governments.
As we have repeatedly said
"To think that our Founding Fathers, after risking their lives
by signing the Declaration of Independence,
fighting, and winning, the War of Independence,
and then struggling to establish a Republican form of government,
would then turn around and grant that government the power
and authority to allow it to become abusive of the people is ludicrous.
They would not do it, and they did not do it."
There are no provisions in our Constitution
that permits the Federal government any law enforcement powers of any kind.
The States reserved all Law Enforcement Powers toTHEIR Militias.
To provide for calling forth the militia to execute the laws of the union,
suppress insurrections and repel invasions:
- Article 1, Section 8, Paragraph 15, Constitution for the united States of America.
Without the ability to persecute the people with
bogus law enforcement activities
the government workers have no ability to intimidate the people
so they can build empires, have the courts create phony laws,
allow the President to issue Executive Orders that function as laws
when only the Legislature has the power to enact a law,
and allow the legislature to ignore the provisions of the Constitution
With over 200 years of "hind-sight"
we now have a better idea of what needs to be clarified
in order to secure our freedoms and pass them on to our posterity.
What we have created is a
National People's Constitutional Convention that is designed
to secure the provisions set forth in the original Articles of our Constitution
We can, and we will, put our rampant Federal Government back into the cage
built by our Founding Fathers when they wrote the Constitution.
We do not want to change the concepts behind OUR Constitution
Our purpose is to merely clarify and expand the restrictions created by the Constitution
to where we never again have to fear our government.
A National People's Constitutional Convention was not possible
just a few short years ago, but now, with the Internet
we can all join in the discussions and participate
in "righting the ship of state"
so it can sail into the future in such manner as to best
effect our safety and happiness.
Do we have the right to do this?
Not only do we have the right
it is our duty, and our obligation to do this.
Let me quote from the Declaration of Independence concerning this matter:
Prudence, indeed, will dictate that Governments long established should not be
changed for light and transient causes; and accordingly all experience hath shown,
that mankind are more disposed to suffer, while evils are sufferable,
than to right themselves by abolishing the forms to which they are accustomed.
But when a long train of abuses and usurpations, pursuing invariably
the same Object, evinces a design to reduce them under absolute Despotism,
it is their right, it is their duty, to throw off such Government,
and to provide new Guards for their future Security - Declaration of Independence

1. We propose the restoration of the True 13th Amendment
"If any citizen of the United States shall accept, claim, receive, or retain any title of nobility or honour,
or shall without the consent of Congress, accept and retain any present, pension, office, or emolument of any kind whatever,
from any emperor, king, prince, or foreign power, such person shall cease to be a citizen of the United States,
and shall be incapable of holding any office of trust or profit under them, or either of them."
Even though the Federal Government now claims this Amendment was not properly ratified
it appears as a valid part of the Constitution in numerous State and Federal publications
beginning in 1812 and continuing up to 1876 when Congress approved the laws for the Wyoming Territory
There are provisions against Titles of Nobility in the Articles of Confederation and our Constitution,
but there was no punishment set forth until this Amendment was ratified
2. We propose the elimination of the unlawfully adopted 14th Amendment
When the Southern States refused to ratify the 14th Amendment Congress violated the Constitution to get it ratified
Congress unseated one of the Senators from New Jersey, in violation of the Constitution, because
he opposed the Amendment. This was done just to get the Amendment through Congress
Then, when the Southern States refused to ratify it Congress declared Martial Law in those States and
removed the duly elected State officials and replaced them with what came to be known as
"Rump" Legislators who ratified the Amendment.

3. We propose the elimination of the unratified 16th Amendment
The opinion letter of the Solicitor General indicated that perhaps as few as 4 states properly ratified the Amendment
When an Amendment is proposed to the States it must be ratified exactly as proposed by Congress
without any changes in wording, punctuation, or capitalization

that outlines all of the changes and modifications that were done by the States
We propose the establishment of a TEN PERCENT (10%) national sales tax
There would be no tax on food or medicine
There would be no tax on used goods, only on new goods, thus eliminating the potential of a double tax on the same items
This tax would be divided as follows
5% to the County where the purchase is made so we can eliminate property taxes
3% to the State where the purchase is made
2% to the Federal Government
If, We, the People determine the tax rate needs to be adjusted then a proposal shall be made
for a vote in the regular election cycle
We, the People, will determine how much we are taxed
4. We propose the elimination of the 17th Amendment
Letting the States once again appoint their Senators will take a lot of the political infighting away from Washington
Our Senators will once again be beholding to the State that appointed them and not to a political party
5. We demand a return to a currency that is backed by precious metals.
The elimination of a fiat currency will remove the ability to just print money to cover the sins of Washington
Because of the current high price of gold and silver it is not convenient to mint pure gold and silver coins
Constitutional Concepts therefore proposes that a new currency be established that is called
a Sovereign, in honor of the Sovereign status of the Members of We, the People
One Sovereign would have a value based on gold equal to ONE (1) grain of pure gold
There are 480 grains in a troy ounce of gold so at today's price of gold each Sovereign would be
worth about $3.50 in Federal Reserve Notes
We also propose that for the next 10 years all U. S. Mining Companies be encouraged to sell a minimum
of 10% of their Net Recovery of gold and silver to the Government, at the full spot price of gold and silver,
in order to restore the hard metal resources backing our currency
6. We mandate that every Citizen is equally subject to every law that is passed
Congress will not longer be able to "Opt Out" of being subject to the laws they pass
7. We mandate that no elected, or appointed person may
serve more than two terms in office or eight years, whichever is more
since Senators serve six year terms
This means that if a person serves a term as a member of Congress they cannot serve more than one term as President.
Judges will be limited to 8 year terms, including the Supreme Court Justices
8. All Government Operations that are not directly empowered
by the Constitution must cease immediately
Constitutional Concepts firmly states that contrary to what everyone has been told by the Government concerning the
so called "Commerce Clause," it does not grant the Government any power over the States or the People
Simply diagramming the sentence shows this to be true
Rather than granting powers to the Federal Government this Clause actually establishes the fact that the
States and the Indian Tribes are as Sovereign and Independent of the Federal Government
as the Foreign Nations
Therefore, all Federal Government activities that are not set forth specifically in the Constitution must cease
Neither the Federal Government, nor any of the several State Governments
have any inherent right to exercise any powers, or authority, or to do anything beyond what the people have granted
Congress can exercise no power by virtue of any supposed inherent sovereignty in the general government.
Indeed it may be doubted whether the power can be correctly said to appertain to sovereignty in any proper sense,
as an attribute of an independent political community. The power to commit violence, perpetrate injustice,
take private property by force without compensation to the owner, and compel the receipt of promises to pay
in place of money, may be exercised, as it often has been, by irresponsible authority,
but it cannot be considered as belonging to a government founded upon law.
But be that as it may, there is no such thing as a power of inherent sovereignty in the government of the United States.
It is a government of delegated powers, supreme within its prescribed sphere but powerless outside of it.
In this country, sovereignty resides in the people, and Congress can exercise no power which they have not,
by their Constitution, entrusted to it; all else is withheld. - Justice Field - Legal Tender Case, Julliard vs Greenman - 110 U.S. 421 (1884)
There are no provisions in the Constitution for:
The Securities and Exchange Commission
The Federal Reserve
The Department of Education
The U. S. Bureau of Land Management
the U. S. Forest Service
The Commerce Department
The Environmental Protection Agency
to name a few
All these, and any other unconstitutional departments, must be immediately disbanded and dissolved
The land held by the Federal Government will revert to the Counties and hopefully eliminate property taxes
Since the Federal Reserve is an unconstitutional entity, i.e., the Federal Government has no power to create
corporations, and the Federal Government has no power to conduct, or control, banking operations,
when the Federal Reserve is closed all of the unlawful debt will simply be cancelled.
9. We mandate a return to the principles of Common Law
Perhaps the most important thing we can do is issue a Mandate that
Our Country returns to the principles of Common Law
These are the laws that Moses brought down from the top of Mount Sinai
These are the laws that the Children of Israel lived by when they lived in righteousness
These are the laws that were brought to America during the initial migration from Europe,
when they were fleeing from the corrupt Civil Courts of Europe
These are the laws that are tied to God's Laws, and as such are the laws that secure and protect
the unalienable rights given to us by our Creator
Common Law belongs to the People
It is OURS
We, The People, dictate, control, use, and are subject to the provisions of the Common Law
In spite of the fact that the Attorneys do not want it because they cannot practice in a Common Law Court,
the Politicians do not like it because We, the People, can demand they obey their Oath of Office, or be removed,
those who would build empires do not like it, because the People can control their actions
Be sure that you completely and thoroughly understand and know that all actions concerning
the Life, Liberty, and Pursuit of Happiness are the sole venue of the Common Law Courts,
and that these are the Courts of We, the People.
The power and authority of the Common Law Courts are as set forth in the
7th Article of the Bill of Rights of the Constitution for the united States of America.
In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved,
and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.

Please note, that We, the People, are guaranteed a Trial by Jury. This is not a jury trial.
Trial by Jury is a Common Law trial where the members of the jury are the justices who conduct the trial and
question everyone concerned with the case in order to arrive at a unanimous decision.
There are no attorneys and there is no judge in a Common Law trial.
It is also interesting to note that Article 3, Section 2, Paragraph 3 declares that the trial of all crimes is to be by Jury.
This demands a Common Law trial and effectively takes the power away from the government to try any Citizen in any Civil Court.
The trial of all crimes, except in cases of impeachment, shall be by jury;
and such trial shall be held in the state where the said crimes shall have been committed;
but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed
- Article 3, Section 2, Paragraph 3, Constitution for the United States of America
The above cite says "trial of all crimes shall be by jury." It does not say in front of a jury, it says BY jury.
Because there is a VAST difference between a Trial by Jury and a Jury Trial.
A Jury Trial is the civil substitute for a Trial by Jury and has been foisted upon the people as part of the scam.
Trial by Jury is a Common Law Trial, as specified in Article 7 of the Bill of Rights.
There is no Judge. There are no Attorneys to speak on behalf of the parties.
The Jury members are referred to as Justices and they conduct the trial by
directly questioning the parties before the court, and render the verdict.
If you want to see a Common Law Court in action, simply watch the United States Supreme Court.
Even though it allows attorneys, it basically functions as a Common Law Court.
The Justices question the participants and render a decision.
We the People retained all rights to the Common Law,
and We made the Common Law Courts Superior to any other court in the land so that
We the People could step in at any time and overturn a decision that is not in keeping
with the Laws that We established in our Federal and State Constitutions.
We must restore OUR Common Law Courts ! !

By inviting everyone to be a delegate to the Convention
we will have the largest delegate base any Convention has ever had.
Even though not everyone will submit comments
we know there will be thousands of delegates who will follow what is happening
and approve of the preceedings, even though they are silent.
We do not need a majority of the people to vote,
We elect our political leaders now with just fractions
of the qualified voters participating in the process.

The Original Constitution was drafted in about 4 months time.
We are proposing 1 1/2 times that amount of time, and we will need every bit of it.
We still place our right hand over our heart and solemnly proclaim
our allegiance to the flag of the United States of America and to the Republic for which it stands.
I pledge allegiance to the Flag of the United States of America,
and to the Republic for which it stands:
one Nation under God, indivisible, With Liberty and Justice for all.
We have not pledged our allegiance to the Democracy. We have pledged our allegiance to the Republic.
The language and the words used herein
shall be construed to be the common everyday language of the people.
No hidden implied messages or meanings are expressed, or conveyed, herein.
What is said is exactly what we mean to say, and exactly what we mean.
